1. Acceptance of These Terms

By accessing or using PhysicianTrack’s websites, applications, or related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. PhysicianTrack is operated by Med Career Center, Inc. (“MCC”). If you do not agree, you must not use the Services.

2. Description of Services

PhysicianTrack is a healthcare recruitment platform. Our Services include job-board features, candidate and employer dashboards, and datasets about physicians and medical residents compiled from public records and other lawful sources. We connect candidates, residents, and healthcare employers and enable communication between them.

3. Accounts and Eligibility

• You must be at least 18 years old to use the Services.
• You agree to provide accurate and current registration information and to maintain the security of your login credentials.
• You are responsible for all activity that occurs under your account.

4. User Content and Conduct

• You may submit professional information such as résumés, job postings, and messages (“User Content”). You retain ownership of your User Content, but grant PhysicianTrack a non-exclusive, worldwide license to use, display, and transmit it as needed to operate the Services.
• You are solely responsible for your User Content. Do not post anything unlawful, discriminatory, defamatory, or otherwise harmful.
• You may not attempt to interfere with the security or proper functioning of the Services.

5. Data Sharing and Licensing

By using our job board, you consent to the sharing of your profile and application materials with employers and recruiters to whom you apply or who are hiring in your specialty.

PhysicianTrack may also license or sell datasets of resident information that are compiled only from publicly available sources such as hospital websites and government records. We do not sell private information you provide in your account unless we have your explicit consent.

6. Privacy

Our Privacy Policy explains how we collect, use, and safeguard your information. By using the Services, you consent to the practices described there.

7. SMS Messaging Program and Consent

PhysicianTrack offers SMS text message notifications related to job opportunities, interviews, and account updates from hiring authorities using the site. By opting in, you consent to receive recurring automated and non-automated messages. Message and data rates may apply. Message frequency varies (typically 1–3 per week). You can opt out at any time by replying STOP, or you can get help by replying HELP.

8. Disclaimers and Limitation of Liability

The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. PhysicianTrack disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, PhysicianTrack and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be brought exclusively in the state or federal courts located in New Hanover County, North Carolina. You consent to the personal jurisdiction of those courts and waive any objection to such venue.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date. Your continued use of the Services after changes means you accept the updated Terms.
